Comprehensive privacy notice

In accordance with the provisions of the Federal Law on Protection of Personal Data Held by Private Parties, its Regulations and related regulations, this Privacy Notice is issued in the following terms:

  1. Identity, address and services of the Responsible.

Enriquez De Rivera Castellanos, S.C. (the "Responsible" or "We" indistinctly) and/or its subsidiaries and affiliates are responsible for the collection, use, disclosure and/or storage of personal data (the "Treatment") of users ("You", the “Holder” or “User”), of its website (www.notaria9.com) (the “Site”) and our social networks (the “Social Networks”). The Controller is domiciled at Av. Lerdo de Tejada 1577, Col. Nueva, C.P. 21100, in the city of Mexicali, Baja California, which is intended to hear and receive notifications.

  1. Personal data collected and processed by the Responsible.

For the purposes indicated in this Privacy Notice, the Responsible Party processes the following categories of personal data and personal data:

  3. Grant security and legal certainty to the facts, acts and legal businesses that it celebrates through public instruments;
  4. Draft notarial public instruments of your interest;
  5. Contact you regarding the status of your account or request for services;
  6. Comply with the legal, regulatory or other requirements that are applicable to it;
  7. Verify the information you provide to us;
  8. Carry out administrative procedures to support the notarial exercise;
  9. Administer, maintain and improve the Site, the Social Networks and their content, as well as carry out the necessary activities for them to function correctly and effectively;
  10. Provide the information requested in relation to the services, the Site and the Social Networks, as well as manage any comments, complaints, clarifications and disagreements related to them; Y
  11. To be in contact with you to inform you about our services or changes in them.





 In compliance with the Law, the Responsible undertakes and is obliged with respect to your personal data to:

  1. Respect and safeguard the principles of legality, consent, information, quality, purpose, loyalty, proportionality and responsibility regarding the personal data to which you have access;
  2. Treat personal data in accordance with the provisions of the Law and the policies of Notary Nine;
  3. Maintain the confidentiality of personal data and treat them exclusively for the purposes for which they were requested or obtained;  
  4. Refrain from collecting any personal data that is not necessary for the aforementioned purposes;  
  5. Attend, in accordance with the provisions of the Law, the procedures related to the exercise of ARCO Rights; Y
  6. Establish and maintain security measures to protect personal data.

 

  1. Options and means that the Controller offers you to limit the use or disclosure of your personal data.

In all legally pertinent cases, you may limit the use or disclosure of your personal data by directing the corresponding request to our Personal Data Officer, following the procedure referred to in number 6 of this Privacy Notice.

  1. Transfer of Personal Data.

Your personal data is only processed by the staff assigned to this Notary for the purpose of preparing the notarial public instruments that you request, therefore, your personal data is not transferred to any third party outside of it.

Occasionally, your personal data is shared to comply with legal requirements before the competent authorities such as public registries, tax and administrative authorities, as well as investigative and judicial authorities within the framework of Mexican legislation.

  1. Means to exercise your rights.

In all legally pertinent cases, you may at any time and through the procedure established in this number, exercise the following rights regarding your personal data: (i) Access, Rectification, Cancellation and Opposition rights (“ARCO Rights”) ; (ii) revoke the consent given to the Controller for the processing of your personal data; (iii) limit the use or disclosure of your personal data; and (iv) express their refusal to process their personal data with respect to the aforementioned secondary and ancillary purposes.

To exercise these rights regarding your personal data, you must submit the corresponding request to the Responsible Party, by means of a free letter duly signed and addressed to our Personal Data Officer, delivering it to the address mentioned in number 1 of this Privacy Notice or sending it to the email address: (notaria9@notaria9.com), establishing as subject “Exercise of rights over personal data”.

The request must comply with the requirements established in the current Personal Data Legislation and must contain and accompany the following:

  1. Your name and address or other means to communicate the response to your request; In the event that the request has been sent by means of the aforementioned email, the Responsible Party may respond by the same means, even if you have not indicated said means as a method to communicate the response to your request;
  2. Copy of the documents that prove your identity (current official identification with photograph) or, where appropriate, legal representation, in accordance with the terms established in the Personal Data Legislation;
  3. Where appropriate, the clear and precise description of the right(s) you wish to exercise; 
  4. In the case of requests for rectification of personal data, the modifications to be made and provide the documentation that supports your request; Y
  5. Cualquier otro elemento o documento que facilite la localización de sus datos personales.

Our Personal Data Officer will process the requests of the owners for the exercise of their rights regarding personal data within a period not exceeding 20 (twenty) business days from receipt and make a request or correct according to the times of the Personal Data Legislation; The person in charge may extend this period for up to 20 (twenty) more business days, when the case warrants it, prior notification. In the event that your request is appropriate, it will be effective within 15 (fifteen) business days following the response by our Personal Data Officer.

As established above, our Personal Data Officer is in charge of processing any requests from the owners for the exercise of their rights regarding personal data and their contact information is as follows:

The Controller wishes to keep his personal data up to date at all times. Therefore, we request your cooperation to timely communicate any changes that we must take into account, to incorporate it into our databases. 

You guarantee and are responsible, in any case, for the veracity, accuracy, validity and authenticity of the personal data provided.

  1. Means that allow the collection of personal data automatically.

We inform you that the Site makes use of cookies and other technologies, of the Responsible and of third parties, through which it is possible to automatically monitor your behavior so that you can navigate the Site and make use of its functions, provide you with our services , remember your preferences, give you an adequate experience while using them, analyze the operation of the Site and adapt and improve it, our services and content and the interaction of users with them, as well as for the offering of products and services based on your preferences. 

The personal data that is collected through these technologies are: IP address, websites and sections of them that you visit from the Site or before the Site, browser characteristics, operating system, language preferences, links to URLs (locators of uniform resources) of selected third parties on the Site, information on actions carried out on our Site, dates and times of visits to the Site, sections, pages or content consulted on it. It is not intended to use such personal data to personally identify any user.
